The High Court of Australia (Fees) Regulation 2012 was registered, Tue 11.12.2012. It repeals and replaces the High Court of Australia (Fees) Regulations 2004 to provide for court fees in the High Court of Australia. Changes include general increases to existing civil law fees by 15%, increasing fees payable by corporations by around 40%, and introducing a separate higher fee for a corporation that is a publicly listed company.
The Family Law (Fees) Regulation 2012 was registered Tue 11.12.2012. It provides a single court fees regulation for proceedings under the Family Law Act 1975 in the Family Court, the Federal Magistrates Court (FMC) and other courts that exercise jurisdiction under that Act. It also implements a range of reforms to court fees in proceedings under that Act, including an increase in the fee for an application for a divorce in the FMC from $577 to $800.
The Family Law Amendment Regulation 2012 (No 4) was registered Tue 11.12.2012. It amends the Family Law Regulations 1984 to repeal provisions in relation to court fees. This is a consequence of the making of the Family Law (Fees) Regulations 2012.
The Federal Court and Federal Magistrates Court Regulation 2012 was registered Tue 11.12.2012. It repeals and replaces the Federal Court of Australia Regulations 2004 and the Federal Magistrates Regulations 2000 with a consolidated regulation for proceedings in the Federal Court and the FMC (other than under the Family Law Act 1975), which makes provision for court fees and other matters provided for in the repealed regulations. It also implements a range of reforms to court fees, including increasing existing fees by 15%, increasing fees payable by corporations by around 40%, and introducing a separate higher fee for a corporation that is a publicly listed company.
All of the above Regulations commence on 1 January 2013.
