The Federal Attorney-General announced on Thur 13.9.2012, that the Federal Magistrates Court will be renamed the Federal Circuit Court of Australia, and the title of Federal Magistrate will be renamed Judge.

The Federal Magistrates Court has occasionally handed down tax-related decisions, such as the decision in Tang & Anor v Bassili & Ors [2011] FMCA 544 (regarding the Commissioner’s garnishee notice to a purchaser of a property in respect of funds applicable to the discharge of the mortgage). Ms Roxon said the Government intends to introduce legislation to implement the proposed changes in the current Parliamentary sittings.
