The Senate Community Affairs Legislation Committee tabled its report on Wed 12.9.2012, in the Senate on the Australian Charities and Not-for-profits Commission Bill 2012, Australian Charities and Not-for-profits Commission (Consequential and Transitional) Bill 2012 and the Tax Laws Amendment (Special Conditions for Not-for-profit Concessions) Bill 2012.

The Committee noted that the Government had adopted the recommendations concerning the Bills made by the House of Representatives Economics Committee.

The Senate Committee recommended the Bills be passed.

In a dissenting report, the Coalition members of the Committee said they did not support passage of any of the 3 Bills. Senator Xenophon recommended the Bills be passed with “appropriate amendments to strengthen [their] intent and purpose”.

In another dissenting report, the Greens recommended that the 2 main Bills (ACNC and Transitional Bills) should be passed only after its concerns and recommendations had been addressed. The Greens also recommended that the Tax Laws Amendment Bill not be passed until further work had been undertaken to resolve the concerns of the not-for-profit sector. Among other things, the Greens said the definition of not-for-profit was “insufficient” and should be amended.
