The ATO on Wed 13.11.2013, released the following Class Rulings:
- CR 2013/85: FBT: clients of YourCarLog Pty Ltd who use the YourCarLog.com Logbook Report. It applies from 1 April 2013. Broadly, the Ruling outlines the conditions under which the logbook report will enable the logbook method under Subdiv 28-F of the ITAA 1997 to be used. It also outlines the conditions for the logbook report to satisfy the requirements of s 10A of the FBTAA.
- CR 2013/86: FBT: taxation implications of the Australian Portable Leave Scheme for employers. It applies from 1 April 2013. Among other things, the Ruling states that an employer can claim a deduction under s 8-1 of the ITAA 1997 for contributions made to the scheme. It also states that payments made are generally an exempt benefit under s 58PA of the FBTAA.
- CR 2013/87: Assessable income: payments received by employees under the Australian Portable Leave Scheme. It applies from 1 April 2013. Generally, the Ruling states that a payment of employee entitlements by the trustee of the scheme to the employee will receive the same taxation treatment, that would have been applicable had the payment been made directly by the employer to the employee.
- CR 2013/88: Endeavour Energy’s Network Business Mix and Match Program. It applies from Wed 13.11.2013 to 31 December 2015. The Ruling broadly states that the early retirement scheme to be implemented is an early retirement scheme for the purposes of s 83-180 of the ITAA 1997.
- CR 2013/89: The University of South Australia – Academic early retirement scheme. It applies from today [Wed 13.11.2013] to 30 June 2014. The Ruling among other things, states that the early retirement scheme to be implemented is an early retirement scheme for the purposes of s 83-180 of the ITAA 1997.
- CR 2013/90: Department of Transport, Planning and Local Infrastructure (Corporate, Finance and Planning Groups) Voluntary Departure Program 2013-14. It applies from Wed 13.11.2013 to 30 June 2014. The Ruling generally states that the early retirement scheme to be implemented is an early retirement scheme for the purposes of s 83-180 of the ITAA 1997.
